A 50-year-old state corrections officer allegedly forced himself on a woman he was supposed to be monitoring.
In exchange for sex, David Garcia gave the woman more freedom to leave her home, recently filed court documents claim.
Now, the community corrections officer is being held in the Franklin County jail with bail set at $250,000 after being arrested earlier this week. He is charged with first-degree custodial sexual misconduct.
Under state law, it’s illegal for a corrections officer to have any kind of sexual contact with an inmate whether it is consensual or not.
Washington state Department of Corrections community corrections officers monitor people after their release from prison. That includes making sure they are following the court-mandated conditions and determining where they can go.
Garcia’s LinkedIn page shows he worked for the state agency for more than 25 years. It’s unclear how long he worked as a community corrections officer.
He currently is on leave without pay while the investigation is ongoing, said Chris Wright, the department’s communications director.
Sexual misconduct
A 40-year-old woman went to Kennewick police about Garcia’s conduct in late 2025. That report reached Pasco police in December.
The woman told investigators that Garcia started monitoring her in September. A month later, he showed up at her house for a random drug test.
He said he wanted to inspect her home, and he allegedly said he needed to “pat her down.”
During the search he allegedly made sexual advances, according to court documents. It went on for about two minutes before she asked him to stop. He allegedly responded, “Why? I know you feel good.”
Before she could leave, he allegedly had her perform oral sex.
“Garcia then stated that she now can go wherever she wanted as they were ‘better acquainted,’” court documents said. “It must be mentioned that (she) is not allowed to leave her residences unless her CCO gives her permission and knows where she is going.”
Police allegedly found suggestive messages that he sent using his work and personal cellphones to the woman.
